Day 5 and Counting

This blog is dedicated to the concept that no one is above the law.

On Saturday, December 17, 2005, President George W. Bush stated:

"In the weeks following the terrorist attacks on our nation, I authorized the National Security Agency, consistent with U.S. law and the Constitution, to intercept the international communications of people with known links to al Qaeda and related terrorist organizations. Before we intercept these communications, the government must have information that establishes a clear link to these terrorist networks."

This is a clear admission by the President that he violated 18 United States Code § 2511. Interception and disclosure of wire, oral, or electronic communications prohibited which requires that "the Foreign Intelligence Surveillance Act of 1978 [50 United States Code §§ 1801 et seq.] shall be the exclusive means by which electronic surveillance, as defined in section 101 of such Act [50 United States Code § 1801], and the interception of domestic wire, oral, and electronic communications may be conducted."

As stated in the United States Constitution, Article II, Section 4:

"The President, Vice President, and all civil officers of the United States shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors."

Violation of 18 USC 2511 is clearly a high crime. The House of Representatives must exercise its duty under Constitution, Article I, Section 2, and institute impeachment proceedings immediately. To this end, on December 18, 2005, Representative John Conyers, Jr. of Michigan introduced House Resolution 635 "creating a select committee ... to make recommendations regarding grounds for possible impeachment."
